General Terms & Conditions

Terms by: GLOBAL MANAGEMENT & TRAINING COMM.V, located in Bonheiden (Belgium). Registered with the Belgian Company Register for Enterprises under number 791.391.029, VAT number BE0791.391.029. Acting as: DIVE PRO GROUP, DIVE PRO TRAINER, and DIVE PRO CAMPUS.

1. Applicability

These supplier terms and conditions apply to all instruction and consultancy activities as listed on our websites. At present, these are diveprotrainer.com, diveprocampus.com, and diveprogroup.com.

​

2. Conclusion of Agreement

A purchase agreement is only concluded upon the dispatch of the order confirmation by us to the customer, following an order placed by the counterparty. The order confirmation is sent after the order in the form of an email containing the invoice. Only the content of the invoice binds the parties. Errors and mistakes are entirely at the buyer's risk and expense. Should you wish to cancel the order after placing it, we request that you inform us immediately before any costs are incurred for this order.

3. Prepayment for Training

Prepayments are required to participate in our training sessions. Registration is only confirmed upon receipt of full payment for the respective training. This means that the customer must pay the full amount before gaining access to the training materials and sessions.

 

In some cases, particularly for professional programs, Global Management & Training Comm.V. may allow payment in installments. However, these payment arrangements are only offered upon approval by Global Management & Training Comm.V. and are documented in the sales agreement. It is important to note that even in the case of installment payments, registration is only confirmed upon receipt of the first installment.

 

Registration for a training is definitively confirmed after payment is received and processed by Global Management & Training Comm.V.. Once full payment is received, the customer will receive a registration confirmation along with further instructions regarding the training.

4. Payment

Registration for a training can be paid with Bancontact, IDEAL, VISA, Mastercard, PayPal, or in advance by bank transfer. Payment by bank transfer is made to:

Stating the order number, invoice number, or the provided structured communication.

5. Delivery Time

Where possible, our training sessions utilize digital materials. These materials are made available to the customer after registration confirmation or upon payment. If physical materials are involved, they will be dispatched within 1 to 2 days if in stock. If not in stock, materials are typically dispatched within 4 to 6 days. In some cases, materials are delivered at the start of the training, due to sensitive information within these materials; the company will always inform the customer accordingly.

6. Shipping and Shipping Costs

We ship via Post or DHL, typically taking one to two days to deliver the package. Shipments are always at the buyer's expense and risk. The choice of shipping method and packaging is at our discretion. The legal delivery time is considered the moment the goods leave our premises. Shipping costs can be found when placing an order.

If the delivery company does not find you at home, you can have your package delivered to a parcel shop nearby.

​

We also offer the option to deliver your order to a different address. During the checkout process, you can provide an alternative delivery address.

​

Orders that are returned to us because they have been refused at the door or not collected will only be resent after the shipping costs have been paid.

7. Prices

The price mentioned by us includes VAT and is in euros. Shipping costs are separately indicated on the invoice. All prices are subject to change. If a product does not have a price listed, you can inquire about the price from Global Management & Training Comm.V.

8. Complaints

The buyer is obliged to inspect the products upon arrival and immediately report any defects. Complaints regarding orders must be made in writing (or by email) to us within 14 days of the goods reaching the buyer. Failure to do so will be deemed as us having fulfilled our obligations. If timely protested and the delivered goods do not comply with the agreement, we will, at your choice and upon return of the delivered goods, either arrange for a one-time free redelivery or credit the returned goods and shipping costs.

9. Extrajudicial Collection Costs

If Global Management & Training Comm.V. has to incur legal costs due to non-performance of the agreement by the buyer, the buyer is obliged to fully reimburse the costs to Global Management & Training Comm.V.. In case of default, all costs incurred by us will be charged, with a minimum of €100.00.

10. Cooling-off Period and Exchange/Return Procedure

Our customers have the right to return the goods within 14 days of receipt (or conclusion of the agreement, in the case of a course or training) and terminate the agreement. The customer must bear the costs of the return shipment. The goods can only be returned in undamaged, unopened, and original packaging. Furthermore, the products must be in the same condition and must not be used and/or worn. Digital products that have already been opened by the customer cannot be credited. Cancellation of registration for a training is not possible more than 14 days after registration or within 2 weeks of the start of the training (taking the first elapsed period).

We will ensure prompt crediting of the invoice minus the shipping and any payment costs. In such situations, Global Management & Training Comm.V. must always be notified by email of the goods to be returned, stating your name and order number. We also appreciate knowing the reason for the return. Goods sent to us without postage paid will not be accepted for return.

 

You must always include the invoice with a return shipment. Returns without an enclosed invoice will not be processed. If we cannot accept an item for return and have to resend it to the customer, all costs will be borne by the customer.

 

As a consumer, you are entitled to have the amount paid refunded within 30 days. In practice, this will take approximately 1 to 2 weeks.

 

11. Access Policy and Cancellation Terms for Non-Payment

At Global Management & Training Comm.V., we strive for a smooth and professional learning experience for all our participants. To ensure the quality of our training and maintain a fair environment, we have specific policies regarding access and cancellations in case of late or non-payment. Below are details of our policy:

11.1 Access Denial: In cases where a participant is negligent regarding the required payments for a training at Global Management & Training Comm.V., we reserve the right to deny access to further training sessions or materials. This may occur after multiple reminders have been sent, and a reasonable period for payment has elapsed without response or payment from the participant.

​

11.2 Session Cancellations: If a participant fails to make timely payment for an ongoing training session, we reserve the right to cancel these session(s) for that specific participant. This may affect the progress and participation of the participant in the training, potentially resulting in missing important learning experiences.

​

11.3. Communication about Payment Arrears: We aim to maintain open communication with our participants in case of payment arrears. Reminders and notifications will be sent to inform the participant of the need for payment and the possible consequences of non-payment according to our policy.

​

11.4. Restoration of Access: Upon receipt of the outstanding payments, access to further training sessions and materials will be restored for the respective participant. However, it is important to note that any missed sessions due to non-payment may not be able to be made up, unless otherwise agreed upon. Therefore, the participant may need to enroll in a new training at a later time or, depending on the type of training, redo the entire training. Costs for this are borne by the participant.

Global Management & Training Comm.V. reserves the right to apply these policies at its discretion and in accordance with applicable laws and regulations. By participating in our training, participants acknowledge this policy and agree to pay in a timely and correct manner according to the billing instructions provided. For any questions or clarifications regarding our access and cancellation policy for non-payment, we invite participants to contact our team for assistance.

 

12. Costs Related to Late Payments

In the event of non-full payment by the customer within 14 calendar days (+ three working days if not sent electronically) after sending the first payment reminder, a compensation is due by operation of law and without formal notice:

​

  • €20 if the amount due is less than or equal to €150

  • €30 plus 10% of the amount due above €150

  • €65 plus 5% of the amount due above €500, with a total limit of €2,000.

​

In the event of non-full payment by the customer within 14 calendar days (+ three working days if not sent electronically) after sending the first payment reminder, the customer is, by operation of law and without formal notice, liable for interest at the statutory rate for late payment in commercial transactions, as per Article 5, paragraph 2 of the law of 2 August 2002 concerning the combating of late payment in commercial transactions, according to Belgian law. These interests are calculated on the amount still to be paid.

 

13. Amendment of Terms and Conditions

Global Management & Training Comm.V. reserves the right to amend the Terms and Conditions at any time, without notice or announcement. By placing an order, the customer agrees to these possible changes and acknowledges that they can always be consulted on one of the company's websites.

14. Disputes

Belgian law applies to all our agreements. Only the departments of the courts or the justice of the peace court competent for the location of the operating headquarters of Global Management & Training Comm.V. are competent in the event of a dispute arising from the agreement between Global Management & Training Comm.V. and the counterparty.
